Your Privacy in HERE Last Mile: driver application
With respect to personal data collected by us through the Service from you, HERE Global, B.V. is an independent controller and your fleet owner is an independent data controller. The term “personal data”, as used in this privacy notice, means any information relating to you where (i) you are identified (e.g. your name, phone number, etc.); or (ii) where you could be reasonably identified (e.g. by reference to device IDs, online identification numbers or persistent cookie identifier etc.).
Please understand that the features of the Service may depend on how you access the Service. Different device models and software versions of the Service may offer different features.
What is HERE’s involvement?
HERE makes available the mobile application targeted to drivers driving for organisations who are customers to HERE Last Mile product. This is referred as the “driver application”.
What information do we collect?
The Service may collect the following information about your device, and your use of the Service. Additional details regarding the data collection may be provided as part of a notice embedded within the driver application.
Registration and contact details
The use of the Service requires creation or use of an existing HERE account. If you don’t have one already, you need to register an account with us. This is to ensure that only authorized and eligible drivers can use the Service.
You may also receive an invite from your organization for both a) downloading the application from available application stores and b) creating a HERE account and being associated to an organization.
Before you are assigned to an organization, you cannot deliver parcels to that organization with the help of the Service.
If your fleet owner or the organization you drive for has already created a HERE account for you, and you would like to terminate it, please contact us at email@example.com to request deletion of your account.
Location data and place information
Our Service makes use of information about your actual location (“Location Data”). Location Data is based on available positioning methods, such as Assisted GPS. In many device models the user interface of the Service identifies the use of positioning with an icon. When you start to use the Service, the Service activates your selected positioning methods to retrieve your current location.
Unless otherwise stated, we use random identifiers in connection with your Location Data that do not identify you personally.
The Service may send your Location Data to HERE when you use the Service's online location-enabled features such as the route plan or navigation during the day of delivery.
We may also collect additional information such as proof of delivery or proof of pickup, which is tied to a specific location.
Positioning and location information
The Service makes use of HERE positioning services, including Wi-Fi or other network-based positioning methods. This involves the collection of any or all of the following: Location Data, speed, direction and timestamp; number of satellites used in positioning; parameters of nearby mobile network towers; parameters of nearby Wi-Fi routers and/or Bluetooth® beacons. With your consent, this information is sent to us on a regular basis, after which it is deleted from your device. This information may also be coupled with a short-lived, at a maximum 15 minutes, session identifier, which doesn’t relate to you, your device or the application you’re using. We do not use this data to identify you personally.
Location tracking functionality and related collection
The Service contains a feature called Location Tracking. When Location Tracking is enabled, the fleet dispatcher will be able to continuously track your location during your use of the Service to help manage deliveries, predict delivery times and analyze performance of the deliveries and/or you as the driver. If you’re taking a break during daily deliveries, you may turn off Location Tracking from the ‘profile’ tab.
Information about Service usage
You may participate in improving our services. See Your privacy in the HERE Improvement Program for more details. You may choose the extent to which you contribute to the improvement of our services. You can always change your preferences in the app settings either in Settings or About.
This information collected for the HERE Improvement Program is sent to us when you use the Service online, after which it is deleted from your device. We do not use this data to identify you personally or combine or otherwise associate this information with your HERE account.
Technical information and your transactions
When you use the Service online, certain technical information such as the type of your mobile device, unique device or network service provider identifiers, internet protocol address, time zone, technical details of your client as well as your transactions with HERE may be automatically collected by HERE.
How we use the information we have collected?
Provision and development of the Service
The information collected by the Service is used to provide you with the Service and to develop our products and services.
Improvement of products and services
We use the collected information to improve and enrich our products and services, including maps and location services. We may also use the information collected to develop new products and services. For these purposes, we may combine information collected by the Service with other data we may already have. What are our information sharing practices?
We may share information about your current deliveries to your fleet owner or the organization you drive for. This is in order for the organization to plan and manage their deliveries accordingly. Please make sure to assign yourself to the right organization during your deliveries. Please also note that while you may receive contact details of recipients to facilitate your deliveries, you are not authorized to retrieve such contact details from the Service and store in any other location.

- with HERE companies and authorised third parties, who process personal data on our behalf;
- where there is a legal requirement to do so.
What safeguards are in place?
The information collected by the Service is protected against unauthorized access and use. The Service uses secured protocols to send the information from the application to our servers.
What is our legal basis for processing your Personal Data?
We process your personal data in context of the Service for the following legal bases:
Performance of a contract with you
We process your personal data to perform our obligations under the Service Terms.
This Service enables you to activate additional optional features and/or functionalities and help us improve the Service.
Once you activate an optional feature or functionality, we process your personal data based on your consent. You may revoke your consent, at any time, by changing your settings in Settings or About. Doing so will bar us from processing of your personal data based on your consent from that point onward, but will not impact the lawfulness of the processing of your personal data based on your consent before it was withdrawn. Please note that some of the features in the Service may only be available to you based on consent.

How long do we retain Personal Data?
We endeavor to only collect personal data that are necessary for the purposes for which they are collected, and to retain such data for no longer than is necessary for such purposes. Where collected, the records of your activity within the application are typically maintained only for a short period before being anonymized or subject to contractual or statutory obligations. You may contact the HERE Privacy Office at privacy@HERE.com to obtain additional information about retention of your personal data.
You can choose the level at which you participate in the development of HERE’s products and services. You may separately turn your participation to the application improvement on and off.
You can enable and disable the Location Tracking feature, which is continuously otherwise making your location available to the fleet dispatcher during your deliveries. This setting is available from the ‘profile’ tab. We recommend disabling the feature while taking a break.
You can only enable the traffic features if you also contribute to the improvement of our services. Once enabled, you can choose the extent to which you contribute to the improvement of our services: only when the app is running or when the app is running or closed. Please note that you may be able to independently turn the traffic layer on and off. This only impacts the visualization of the traffic content.
You can switch positioning services on and off using your device settings. Device positioning settings also control HERE positioning services, including the supplementary data collection related to HERE positioning, as outlined above. If you configure your device such that you are not using any assisted positioning methods, HERE positioning services will also not be used.
